General Terms and Conditions
These General Terms and Conditions apply to SCHERNTHANER TOURISTIK GMBH (Ski and Snowboard School and Ski Rental).
1. General:
Unless expressly agreed otherwise, these General Terms and Conditions (hereinafter referred to as "GTC" or "Terms and Conditions") shall apply to all legal transactions and contractual relationships concluded between the Ski & Snowboard Schools in Salzburg and their customers as contractual partners.
The subject matter of the Salzburg Ski & Snowboard Schools is the operation of snow sports schools in the sense of ski and snowboard schools.
This therefore includes the services of providing instruction in the skills and knowledge of snow sports, in particular skiing and snowboarding (without guaranteeing a specific training success), as well as leading and accompanying snow sports, particularly skiing and snowboarding.
Also included is the provision, on the request of the contractual partner, of paid or free ski or snowboard equipment, or its brokerage, in the context of or to facilitate the lessons (ski or snowboard rental or rental of complete or partial ski or snowboard equipment).
2. Reservation, Offer, Order Confirmation, Contract Conclusion, Online Price Queries and Prices:
- Reservations for individual and group courses can be made in person on site, via the Internet, or by telephone.
- The offers of the Ski & Snowboard Schools in Salzburg are non-binding.
- Only the written order confirmations of the Ski & Snowboard Schools in Salzburg are decisive for the acceptance of the reservation and the scope of services.
- Oral or telephone side agreements are only valid if expressly confirmed in writing by the respective Ski & Snowboard School in Salzburg.
- For bookings on site (individual and group courses), a contractual relationship is only established upon purchase or issuance of the necessary course card.
- The same applies to bookings using remote communication methods, whereby the necessary course card must be collected by the customer before the start of the service.
- In all cases, the course card is only issued after full payment of the course fees before the start of the course.
- Both the Ski & Snowboard Schools and the ski and snowboard rental providers are entitled to use subcontractors for the provision of snow sport instruction or the provision or brokerage of ski or snowboard equipment.
- All prices quoted by the Ski & Snowboard Schools in Salzburg are in EURO and, unless otherwise agreed, include statutory VAT. Information in price lists is provided without guarantee. No liability is assumed for printing errors.
- If a group decreases to fewer than 4 participants, we reserve the right to merge the group or reduce the number of lesson hours.
- Multiple instructor changes are possible due to flexible organisation.
3. Cancellation Policy:
Cancellation conditions for online bookings of ski courses, snowboard courses, private lessons, and ski course packages
With insurance:
- Cancellation without giving a reason up to 2 days before the course starts
- No processing fees
- For package bookings, the complete ski or snowboard equipment is insured against breakage and theft
Without insurance:
- Up to 7 days before the start of the trip: 50% refund. Reason for cancellation required (written confirmation, e.g., doctor).
- Up to 30 days before the start of the trip: 100% refund (written confirmation, e.g., doctor).
- For all cancellations, a processing fee of €25 will be deducted.
All deliveries and services of the ski school based on online orders via the Internet or other online services are subject to these terms and conditions.
The cancellation must be made in writing, together with the reservation confirmation (voucher), to skischule@ski-kleinarl.at.
4. Online Offers and Online Bookings:
All services of the Ski & Snowboard Schools in Salzburg, which are provided as a result of online enquiries and orders using the Internet or other online services, are subject to these terms and conditions.
4.1. Content of the Online Offer:
The Ski & Snowboard School / Ski and Snowboard Rental (hereinafter briefly referred to as "Author") assumes no responsibility for the timeliness, correctness, completeness, or quality of the information provided.
Liability claims against the Author relating to any type of material or non-material damage caused by the use or non-use of the information provided, or by using incorrect or incomplete information, are generally excluded, unless there is proven gross negligence on the part of the Author.
All offers are non-binding. The Author expressly reserves the right to change, supplement, delete parts of the website, or the entire offer, or to suspend publication temporarily or permanently without prior notice.
4.2. References, Links:
In the case of direct or indirect references to third-party websites ("links" or "hyperlinks") that are outside the Author's area of responsibility, the Author is generally not liable, unless the Author had prior knowledge of illegal content on the respective websites or copyright violations and, despite actual knowledge, grossly negligently failed to prevent or prohibit third-party use of such content, provided this was technically possible and reasonable.
The Author expressly declares that at the time the link was set, no illegal content on the linked websites was recognisable or known. The Author has no influence on the current and future design, content, or authorship of linked websites. The Author expressly distances themselves from all content of linked or connected websites that has changed after the link was created. This applies to all links set within the Author's own website as well as third-party entries in guestbooks, discussion forums, mailing lists, etc.
For illegal, incorrect, or incomplete content and in particular for damages arising from the use or non-use of such information, liability lies solely with the provider of the linked website, not the one who merely refers to it via links.
4.3. Copyright and Trademark Law:
The Author strives to respect the copyrights of used graphics, audio files, video sequences, and texts in all publications, to use graphics, audio files, video sequences, and texts created by themselves, or to resort to license-free materials.
All trademarks and brands mentioned within the online offer, potentially protected by third parties, are fully subject to the provisions of applicable trademark law, other relevant legal regulations, and the ownership rights of the registered owners.
Mere mention does not imply that trademarks are not protected by third-party rights.
Copyright for published objects created by the Author remains solely with the Author. Reproduction or use of such materials in other electronic or printed publications is not permitted without the Author's explicit consent.
By accepting the GTC of the Salzburg Ski and Snowboard School, the course participant expressly consents that photographs may be taken during ski lessons and associated events and published on the website or Facebook page of the Salzburg Ski and Snowboard School. The participant cannot derive any rights from this, thereby expressly waiving such rights by accepting the GTC.
The participant may revoke consent to the publication of photographs depicting them or their child at any time in writing, specifying the particular photograph.
5. General Participation Conditions:
The contractual partner must provide the Ski & Snowboard Schools in Salzburg with truthful and complete information about their skills and experience in various snow sports, particularly skiing and snowboarding, at the beginning of the course.
They must independently ensure they have equipment appropriate for the level of snow sport technique, particularly ski and snowboard technique, and suitable for the external conditions, and bear the costs themselves.
They must also inform the Ski & Snowboard School in Salzburg about their health condition and any ailments that may affect or be aggravated by snow sport.
If the partner uses their own ski or snowboard equipment, they must have it technically checked, particularly skis, snowboards, and bindings, by a specialist before the start of lessons.
The Ski & Snowboard School is not liable for any damage resulting from non-professional or insufficient checks, adjustments, or maintenance of the equipment.
Each partner is responsible for the technical safety and proper functioning of their equipment and must cover any resulting damage themselves.
The Ski & Snowboard School may prohibit a participant from attending a course if the equipment poses a safety risk until the defect is rectified, without the participant having a right to a reduction in fees for missed lessons.
Group allocation and skill assessment in courses are carried out by the Ski & Snowboard Schools in Salzburg. If a participant needs to be downgraded, the partner must follow this decision.
Failure to comply allows the school to terminate the contract immediately, without entitlement to a refund.
Instructions from the Ski & Snowboard Schools in Salzburg must be strictly followed. Non-compliance authorises immediate contract termination.
Intoxication by alcohol or drugs also permits immediate contract termination without refund.
If group numbers drop below five, the school may merge groups or reduce lesson hours accordingly.
6. Liability Provisions:
It is strongly recommended that the contracting party of the Ski & Snowboard Schools in SalzburgerLand take out health, accident, liability, and travel health insurance.
The Ski & Snowboard Schools in SalzburgerLand are liable according to statutory provisions only for damages related to the activities of the Ski & Snowboard Schools in SalzburgerLand, caused intentionally or by gross negligence, whereby the exclusion of liability applies to contractual and tortious claims for damages of any kind, but generally not to personal injury.
The Ski & Snowboard Schools in SalzburgerLand maintain appropriate liability insurance.
Furthermore, the respective Ski & Snowboard School is not liable in any case if the contracting party causes injury to themselves, suffers damage, or causes damage of any kind by disregarding the instructions of the Ski & Snowboard School, the FIS piste rules, other legal provisions, or the terms and conditions herein.
Should the contracting party suffer damages arising from equipment provided or arranged, whether free of charge or for a fee, the contracting party shall hold the Ski & Snowboard School harmless.
If the contracting party is a business (e.g., travel agency or tour operator), the statute of limitations for asserting claims against the Ski & Snowboard School is six months from becoming aware of the damage.
7. Complaints:
Any complaints must be reported immediately on-site to the respective office of the Ski & Snowboard School in SalzburgerLand to allow prompt rectification and continuation of service.
If the contracting party does not exercise their right to complain immediately, at the latest by the end of the service provision, any claims for fee reduction can no longer be considered.
Other claims against the Ski & Snowboard Schools in SalzburgerLand must be submitted in writing within four weeks of the occurrence or knowledge of the cause of the claim and justified.
8. Withdrawal:
For group courses and private lessons, a refund of payments already made is only possible in the event of accident or illness upon presentation of a medical certificate from a local doctor. The refundable amount will be recalculated based on the services actually provided during that period. This may reduce the total amount, but the daily rates may increase. No refund is given for no-shows or withdrawal during an ongoing service.
In case of weather-related course cancellations or force majeure, fees paid to the Ski & Snowboard Schools in SalzburgerLand will not be refunded.
Lift usage fees are not included in the course fee. All costs for using lift facilities are borne by the course participant. The Ski & Snowboard School does not compensate for lessons lost due to ski lift or cable car outages.
9. Safety:
Course participants are explicitly informed that children and adolescents, according to the Salzburger Landessportgesetz 1988, LGBI. No. 98/1987, up to the age of 15, are required to wear a ski or snowboard helmet compliant with ÖNORM EN 1077:2007 while practicing alpine skiing or snowboarding.
Furthermore, participants must familiarize themselves with and adhere to the applicable FIS piste rules.
10. Provisions Related to COVID-19 (SARS-CoV-2 Virus / CORONA Virus):
10.1. Obligations and Declarations of the Contracting Party:
The contracting party is generally aware of the global COVID-19 pandemic and resulting restrictions.
The contracting party must inform themselves about all relevant restrictions, rules, and recommendations applicable to the region in which the Ski & Snowboard School is located. This includes COVID-19 regulations for accommodation and cable car operations.
The contracting party acknowledges their personal responsibility to follow hygiene measures such as regular handwashing, maintaining distance, wearing face masks where required, coughing/sneezing into tissues or the elbow, and avoiding physical greetings to prevent virus spread.
The contracting party must comply with all instructions from the Ski & Snowboard School or rental service aimed at ensuring the health safety of all parties. These instructions apply to school premises, meeting points, and all locations visited during lessons.
The contracting party also agrees to follow instructions and rules communicated by third parties (e.g., lift operators, accommodation, restaurants) that apply during their use of Ski & Snowboard School services.
The contracting party declares that in the 14 days prior to the first lesson they have not shown any COVID-19 symptoms and have had no known contact with infected persons.
If symptoms occur before lessons, such as dry cough, shortness of breath, loss of taste/smell, sore throat, or fever, the contracting party must stay away from lessons and contact the health advice line at 1450. This also applies if COVID-19 infection is suspected.
If relevant symptoms occur during lessons, the contracting party must immediately inform the school to allow isolation from others.
The contracting party acknowledges that even the infection or positive test of another participant may result in course interruption, quarantine, or mandatory testing at their own expense.
The contracting party agrees that their personal data may be used for contact tracing related to COVID-19.
10.2. Special Provisions for Contractual Relationships:
Performance is possible for the Ski & Snowboard School:
If performance is possible but the contracting party does not participate, the provisions under point 8 “Withdrawal” apply analogously.
This applies even if the contracting party cancels participation due to suspected or confirmed COVID-19 infection before or during the service.
Performance is generally possible as long as the ski area is open, and lift/cable car operations are not completely suspended.
Closure of accommodation, third-party facilities, or infections in the area do not make performance impossible.
This also applies to travel restrictions or warnings that the contracting party could reasonably foresee.
Performance is partly or fully impossible for the Ski & Snowboard School:
In the following cases, the school’s duty to provide service is partially or fully suspended, and the contracting party receives a voucher for a future lesson period unless a written refund request is made:
- Official closure of operations affecting the Ski & Snowboard School,
- Official suspension of lift/cable car operations required for the course,
- Government-mandated quarantine of the town or region of the school, or
- Mandatory official travel restrictions for the contracting party that were unforeseeable.
The school’s obligation also ceases if teacher accommodations are affected by COVID-19 cases, resulting in ≥10% of staff unavailable. The school is not obliged to purchase substitute lessons.
Performance is possible only after contract adjustment:
If group courses are prohibited by authorities, the school may adjust the contract or fees for individual lessons accordingly, under the following conditions:
- The restriction was unforeseeable at contract conclusion,
- The restriction applies to the contracted period,
- Individual lessons are permitted,
- Performance is still possible in principle (slopes not completely closed, lifts still operating), and
- The customer has not withdrawn per 5.1 “Withdrawal Conditions.”
10.3. Special Liability Provisions:
The Ski & Snowboard School assumes no liability for any damage or disadvantages arising from COVID-19, even if the contracting party becomes infected despite following precautions or if infection occurs during the course.
This includes cases where lessons are partially or fully possible, but the participant cancels due to confirmed or suspected infection.
11. RENTAL TERMS for Ski and Snowboard Equipment – SCHERNTHANER TOURISTIK GMBH
11.1 The renter is fully responsible for the rented equipment.
11.2 Lending the equipment to third parties is prohibited.
11.3 The rental price is due at the start of the rental. The renter must present a valid ID (passport or driving licence), and a copy will be made. A signed blank credit card slip, original ID, or cash deposit equal to the equipment’s current value is required as collateral.
11.4 Equipment is generally insured against breakage and theft. In case of damage, the deductible applies as follows:
- SILVER Class: €200
- GOLD Class: €300
- PREMIUM Class: €400
- DIAMOND Class: €500
- Children’s skis ≤110 cm: €100
- Children’s skis >110 cm: €140
- Snowboard: €250
- Ski boots: €100
- Children’s ski boots: €60
- Poles: €30
- Helmet: €40
Payment of €7.50 (max 2 days) or €15.00 (≥3 days) removes the deductible for adult equipment in case of theft or damage. For children’s equipment, fees are €4 (≤2 days) or €8 (≥3 days). Snowboard equipment follows the same rules.
Theft requires a police report; intentional damage must be paid for. Exchange of equipment is possible; upgrades require payment of the price difference. Refunds are given only with a doctor’s note for early return due to injury or illness.
Storage of equipment must prevent theft or confusion. Ski bindings are adjusted to boots according to ISO 11088; additional top-safety adjustment is recommended for €21.
12. Jurisdiction, Place of Performance, Governing Law:
Place of performance is the central office of the Ski & Snowboard School / rental. Austrian law applies. The contractual language is German.
13. Legal Validity:
If any provision of these T&Cs is invalid, the remaining provisions remain in force. The invalid provision is replaced by one closest in economic effect. Changes must be in writing.
